National Museums Board (NMB) is a Statutory Board under the Ministry of Tourism whose mandate is to establish, develop and manage dynamic and sustainable national museums for the preservation and interpretation of Movable heritage for the benefit of the present and future generation.
1. LEGAL COUNSEL
Type of Employment – Three (3) Years Contract of Service
Location – National Museums Board Secretariat, Lusaka
Job Purpose
To provide strategic legal advice and leadership to National Museums Board, ensuring legal compliance, effective management of legal risks, contracts, litigation and regulatory matters while safe guarding the interest of NMB.
Main Duties
▫ Manage the preparation of annual work plans and budgets for the Department and facilitate smooth execution of the activities by officers;
▫ Ensure that the activities and operations of NMB comply with applicable international laws, regulations, statutory requirements, and other relevant legal instruments;
▫ Managing and being responsible for the legal archive of NMB and for keeping records of contracts/agreements, judgments, instructions and memorandum of understanding concerning NMB;
▫ Responsible for providing legal advice and counsel to the Board, Director General (DG) and Senior Management on matters or directing to the mandate, governance and legal activities of NMB;
▫ Representing the Legal Department in internal and external meetings;
▫ Responsible for drafting, analyzing and reviewing laws, orders, instructions, regulations, rules of procedure and contracts relating to all activities of NMB;
▫ Responsible for preparing judicial or extra judicial legal actions on behalf of NMB;
▫ Receiving summons and be responsible to prepare rebuttal pleadings for NMB;
▫ Liaise with external legal counsel and Principal State Attorneys on litigations, judgments and legal matters affecting NMB;
▫ Responsible for coordinating with the Human Resources Department the implementation of legal training for NMB staff;
▫ Identify potential changes to the NMB Act and manages the legal reform process and the introduction of new legislative measures aimed at improving the Zambian business environment;
▫ Draft and peruse legal documents, statutory instruments, Cabinet memoranda, contracts and agreements, pleadings, affidavits, deeds, leases and applications in order in order to safeguard the Board’s interests and ensure that they are efficiently and effectively executed
▫ Manage the preparation of periodic and adhoc reports on cases and other legal matters that have a bearing on the Board;
▫ Supervise and review the performance of subordinates to ensure effective execution of work plans and related activities in key result areas;
Desired Attributes
▫ Knowledge of public and administrative law, corporate law, contracts and intellectual property regulation and the NMB Act and policies;
▫ Proven ability in drafting contracts and provide legal advice to large institutions (either public or private) concerning agreements on large public or public-private investment/projects;
▫ Proven ability to inspire, coach and develop the skills of co-workers;
▫ Excellent teamwork skills;
▫ Capacity to interact with public stakeholders and understanding of Government’s processes.
▫ Ability to provide legal advice on NMB matters and deal with issues arising from the Board’s initiatives and activities
▫ Knowledge of procedures and practices used in the conduct of civil litigation; judicial procedures and rules of evidence
▫ Strong interpersonal and influencing skills
▫ High level of integrity and confidentiality
▫ Good Communication skills- both written and oral
Qualifications
▫ Grade 12 School Certificate or its equivalent with at least five (5) credits, including English
▫ Bachelor of Laws Degree (LLB)
▫ Post graduate Diploma in Legislative Drafting
▫ Advocate of the High Court of Zambia
▫ Member of LAZ in good standing
▫ Have not less than seven (7) years’ experience at the Bar
